Terms and Conditions

These terms and conditions apply to all aspects of everything related to PoppaJoes LLC. 

Poppa Joes LLC as defined within this service agreement: Regarding any of the Sports Bar and Grills any of our customers agree to respect and consider everyone inside the facility including property, customers, employees, and anything within the entire property to include any part of the property. Any unruly or disorderly conduct can result in being escorted off the property and possibly banned depending on the staff or local law enforcement. In the event of a dispute on any food or beverages including, all pool tables, arcade, or slot machines will be deemed ruled solely by staff at the time of the incident. No refunds will be given but can be given a voucher in the event of any failure of any products or services at the time of the incident. Any problem dealing with any food or beverage, the unused portion must be turned in at the time of the complaint, equipment malfunction will be left up to the staff at the time of the failure. Any items that are picked up or purchased to leave the location must be inspected prior to leaving the immediate and if not reported before departure Poppa Joes will not be responsible. With any event involving our catering, in every estimate that is signed prior to the event the customer is responsible to read and verify these terms prior to the actual date of the event. The catering estimate is given as an hourly rate for services rendered, with any food and beverages that are purchased in advance and any items that are not used will be at the discretion of staff at the event. Any time worked beyond any time purchased will be charged at time and a half of the rate purchased. With any products that are shipped nationwide by PoppaJoes LLC will be delivered within two days in the continent of the United States, however we hold no responsibility for any unforeseen problems by the shipping company who will deliver our products. If in the event there are any issues with any of our products contact us immediately by calling us at 1 (913) 420-3101 with your order number and we will return the corrected item(s) or make any adjustments according to each instance. If the package appears damaged because of the shipment, first contact PoppaJoes LLC and we will give the best result to resolve your issue. Any monthly subscription must be paid prior to receiving any services and in the event of the subscription having expired no services will be provided until the subscription is in good standing.  

Acceptance of Terms: By using any of PoppaJoes LLC products or services you fully accept all of the terms of services and conditions that are contained in this agreement and are bound to everything within. 

Account Terms: You agree to comply to any applicable requirements for creating and maintaining an account and agree to be held accountable on any misconduct or any illegal activities done on any PoppaJoes LLC property or websites. 

Changes to Terms: PoppaJoes LLC reserves the right to modify or change the terms of service at any time and notify users of changes. 

User Responsibilities: Our customers agree that none of these products and services will not be changed or modified without prior written consent by PoppaJoes LLC. 

Right to Modify: PoppaJoes LLC reserves the right to modify, suspend, or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice at any time. You agree that PoppaJoes LLC shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the services. 

Updates and Changes: PoppaJoes LLC may from time to time provide enhancements or improvements to the features/functionality of our services, which may include patches, bug fixes, updates, upgrades, and other modifications („„Updates”). All Updates are subject to these Terms and may be accompanied by additional terms. You agree that PoppaJoes LLC has no obligation to provide any Updates or to continue to provide or enable any features or functionality of the services. 

User Responsibility: The customer is your responsibility for ensure that you are using the most current version of the services and to comply with any updates or changes that we may implement. 

User Obligations: The customer is obligated to abide with the entirety of this agreement 

Intellectual Property: PoppaJoes LLC reserves our organization’s intellectual property rights and under no circumstances will be relinquished for any reason. 

Termination: In the event of any of these conditions are changed or modified under this agreement PoppaJoes LLC can terminate or limit your access or permissions. 

Disclaimers and Limitation of Liability: Acts of God or any damages that may result from a third party PoppaJoes LLC will not be liable for these issues. 

Limitation of Liability: PoppaJoes LLC provides the services “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 

Limitation of Damages: To the maximum extent permitted by applicable law,  PoppaJoes LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from  use or inability to use our services or any unauthorized access to or use of our servers and/or any personal information stored within or any interruption or cessation of transmission to or from the services. 

Governing Law: These Terms are governed by and construed in accordance with the laws of the state of Kansas, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Kansas for the purpose of litigating any disputes. 

Compliance with Laws: You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of our services. 

Prohibited Activities: You agree not to engage in any of the following prohibited activities: 

Using the services for any unlawful purpose or in violation of any local, state, national, or international law. 

• Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity. 
• Interfering with or disrupting the services or servers or networks connected to the services. 
• Using any automated system, including but not limited to robots, spiders, or offline readers, to access the services in a manner that sends more request messages to the servers than a human can reasonably produce in the same period. 
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the services. 
• Collecting or harvesting any personally identifiable information, including account names, from the services. 
• Using the services for any commercial solicitation purposes. 
• Modifying, copying, distributing, or creating derivative works based on the services or any content available through the services. 

Account Security: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

• You do not have a right to transmit under any law or under contractual or fiduciary relationships. 
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party. 

Modifications to Services: The only parties who has the authority to change or modify this agreement without prior written approval or authorization is PoppaJoes LLC 

Privacy Policy: PoppaJoes LLC will keep any and all customer information private and will not be sold or given to any outside source. 

Data Collection: We collect personal information that you provide to us directly, such as when you create an account, make a purchase, or contact us for support. This may include your name, email address, phone number, payment information, and any other information you choose to provide.

Termination by User: If you wish to terminate your account, you may simply discontinue using the services. If you wish to delete your account, please contact us at [your contact information]. 

Effect of Termination: Upon termination of your account, you will lose all access to any data or content stored in your account. We are not responsible for any loss of data or content because of the termination of your account. 

Survival of Terms: All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. 

Responsibility for Content: You are solely responsible for any content that you create, submit, post, or display on or through our services. This includes any text, images, videos, or other materials (“User Content”). 

Rights to User Content: By submitting User Content, you grant PoppaJoes LLC a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the services and PoppaJoes LLC’s business, including without limitation for promoting and redistributing part or all of the services (and derivative works thereof) in any media formats and through any media channels. 

Prohibited Content: You agree not to submit User Content that: 

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable. 
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party. 
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment. 
• Impersonates any person or entity or falsely states or otherwise misrepresents your affiliation with a person or entity. 

Monitoring and Removal: PoppaJoes LLC reserves the right, but not the obligation, to monitor, edit, or remove any User Content that we determine in our sole discretion violates these Terms or is otherwise objectionable. However, we do not assume any responsibility or liability for User Content or for any failure to remove or delay in removing such content. 

Feedback: If you provide us with any feedback or suggestions regarding the services, you grant PoppaJoes LLC a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the feedback in connection with the services and PoppaJoes LLC’s business. 

Rights to Feedback: By submitting Feedback, you grant PoppaJoes LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Feedback in connection with the services and PoppaJoes LLC’s business, including without limitation for promoting and redistributing part or all of the services (and derivative works thereof) in any media formats and through any media channels.

Your Agreement to Indemnify: You agree to indemnify, defend, and hold harmless PoppaJoes LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from: 

• Your use of and access to the services. 
• Your violation of these Terms. 
• Your violation of any rights of another party, including any users. 
• Your violation of any applicable laws, rules, or regulations. 

Notification and Cooperation: PoppaJoes LLC will provide you with notice of any such claim, suit, or proceeding. You agree to cooperate fully with PoppaJoes LLC in the defense of any claim. PoppaJoes LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. 

Use of Third-Party Services: Our services may include links to third-party websites, services, or resources that are not owned or controlled by PoppaJoes LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that PoppaJoes LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. 

Third-Party Terms and Conditions: When you use third-party services, you are subject to the terms and conditions and privacy policies of those third parties. We encourage you to read the terms and conditions and privacy policies of any third-party websites or services that you visit. 

No Endorsement: The inclusion of any link to a third-party website or service does not imply endorsement by PoppaJoes LLC of the third-party website or service or any association with its operators. Any items or literature send to PoppaJoes becomes the property of PoppaJoes LLC and retain all rights to use print or modify and use at the discretion of PoppaJoes LLC. 

No Obligation: You acknowledge and agree that PoppaJoes LLC is not obligated to use, display, or compensate you for any Feedback you provide. 

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
